Terms of trading

Project Amendments
Should the client identify areas of interest during the course of a project which may require further graphic design or development beyond the scope of the original brief; de Masi jones reserves the right to review its fee structure in accordance with the extent of additional work required to complete the project to the standard and timeframe as directed by the client initially.

Intellectual Property
Intellectual property remains the commercial property of de Masi jones Pty Ltd until the reciept of final project payment and/or a fee has been negotiated to release the IP to the client. Where paid concepts have been presented to a client, these are purely illustrative of a possible direction that the client may wish to further develop, and at no time are clients authorised to take these concepts to another creative agency for further development, or launch the idea commercially, unless a fee for the copyright has been negotiated and paid to de Masi jones.

Assignment of Copyright
If de Masi jones are commissioned to complete the project, at the completion of the works, and following receipt of payments due
as described in this document, de Masi jones will execute a Deed of Assignment and global ownership of the selected design work will be transferred to the client at a fee and on terms that are agreed.
NOTE: All creative work put forward but not selected by the client will remain the property of de Masi jones.

Authors Corrections
Additional author’s corrections and or typesetting undertaken above and beyond those hours quoted on any size project will be billed to the client at a $130 hourly rate.

Project Hold
In the event that a project remains in progress or on hold for longer than 30 days, our standard procedure will be the issuing of a progressive invoice for the proportion of work completed to date.

Print Buyer
Unless otherwise agreed, where de Masi jones is the print buyer, a 50% payment for print production is to be paid at the commencement of a job where the total value of the print exceeds $20,000.

Fees/Costs
Unless otherwise stated, our prices are GST inclusive.
de Masi jones standard hourly rates are as follows:
Senior Strategy | $150 per hour
Senior Design/Art Direction | $130 per hour
Graphic Design | $130 per hour
Typesetting | $120 per hour
Project/Account Management | $130 per hour
Production Management/Coordination | $130 per hour

Disbursements
Disbursements are estimated based on the project brief and requirements as outlined in the proposal, and agreed upon by de Masi jones and the client. These costs may be subject to change should the client request changes to the brief or requirements after the commencement of the project. Disbursements are external costs associated with the facilitation and completion of a project which extend beyond our standard design service fees such as couriers, Xerox proofs, scanning of high quality imagery, retouching of imagery, CD burning, photography, copywriting and any other materials or services that may be used in bringing the project to completion. Unless otherwise specified, the sourcing, analysis, selection and supply of any photographic images will be billed additionally at cost for the time spent at an hourly rate of $90.

Travel Expenses
Airfares and accommodation for personnel required to visit interstate or international destinations for or on behalf of our clients will be billed at cost in addition to our quoted fees.

Validity
Our Proposals are valid for 30 days from the date of issue.

Invoicing
de Masi jones will invoice the client on a monthly, staged or time-line basis. Our payment terms are strictly 14 days from the date of invoice. A 20% (GST inclusive) deposit is payable on signing of a work authorisation for work exceeding $5000 in total. Contingent assignments (those under $5000 GST inclusive) will be (unless otherwise agreed) payable to de Masi jones in full upon completion of the project.

Confidentiality
de Masi jones is acutely aware of the necessity for protection of the confidentiality of our work for our clients. Please note that each employee of the company has signed a confidentiality agreement and we would be very happy to provide you with a copy of that document if required. Further, should your company require de Masi jones to sign any specific form of confidentiality agreement relating to your organisation's business interests and projects, we would be happy to arrange for the execution of such a document
by the appropriate personnel if necessary, but only after the docuement has been reviewed by de Masi jones’ legal counsel.

Legal Processes
de Masi jones would like to draw your attention to the advisability of ensuring your brand name, identity and trade marks are protected legally.
While de Masi jones has a great deal of experience in guiding clients to protect their best interests in this regard, such legal advice should be provided by expert patent and trade mark solicitors. Upon request, de Masi jones would be pleased to recommend a suitable firm with specific knowledge of, and extensive experience in, the design industry.

Service capabilities

Thomas de Masi serves as Creative Director and Accounts Manager on all major projects.
To ensure prompt responses to client deadlines and last minute alterations, de Masi jones have recently undertaken a QA standards, project logistics and procedures review with BDG International.

As part of this process to support our QA system, we have appointed a dedicated Production Director and we utilise state-of-the-art project management and logistics-software.

To support our studio’s capabilities and the ever changing industry, de Masi jones undertakes regular on-the-job-training in several leading industry standard software packages, to maintain a consistent and up to date knowledge and expertise of today’s design technologies.
